Request for the Grant of Rights of use of Radio Spectrum for the Provision of Electronic Communications Networks and/or Services (MCA/F/12-0756)


1. This application form outlines the information required to submit a formal request for the grant of rights of use of radio spectrum for the establishment and operation of an electronic communications network capable of providing electronic communications services.

2. If an applicant intends to provide a commercial electronic communication service, then prior to issuance of the licence the applicant must register as a company in accordance with Maltese law. The Malta Communications Authority (MCA) may exempt applicants from this requirement in cases where the radio spectrum will be used for the provision of non-commercial electronic communications services.

3. Where the applicant is located overseas the applicant must include an address for service of notice in Malta. If the application is successful the applicant must, as a minimum, be registered as an overseas company in accordance with Maltese law prior to the issuance of the licence.

4. Applicant companies must also submit a signed copy of their Memorandum and Articles of Association.

5. The radio frequency spectrum to be assigned by this application is regulated by the Electronic Communications (Regulation) Act (Chapter 399 of the Laws of Malta).

6. Radio spectrum licences issued by the Malta Communications Authority (hereafter ‘the MCA’) do not absolve the holders of such licences from any legal requirement to obtain any other permissions, authorisations or licences, however so described, as may be necessary for the provision of the services and/or for matters relating to the deployment of the related electronic communications infrastructure.

7. Completed forms must be sent to the MCA at the address indicated in this form. Incomplete forms will be returned to the applicant.

8. If deemed necessary, the MCA may seek further information or clarifications from the applicant.

9. Any legal dispute between the Authority and an applicant shall be governed solely by Maltese law and shall be subject to the exclusive jurisdiction of the competent Maltese courts and or tribunals however so described.
